They didn't say they were fan created. They were indeed on the disc, and they instead said that they weren't ND officially approved for the final release.... AKA they changed their minds after they made them and left/forgot them on the disc.

During an old Q&A I think Naughty Dog said they didn't create them. I could be wrong though.
You can clearly see the 4th legacy badge and the level 100 skull emblem on there which is now a Emblem as 5th legacy reward instead. There where even forumers who wondered about that silver star till people started to get it by beating the co-op adv. on crushing. This was when the 3th legacy still was the cap so no way it could be fan created. They where found on the disk but ND didn't used them for whatever reason. Also they don't even know what they are talking about in these Q&A's. Eric said the UC3 MP models look better than the UC2 ones. Yeah, right.

Not like this all really matter tbh, I mean it wasn't the best idea to add ranks late in the games life but it certainly wouldn't be good to change it even more lol
Yeah, they meant they didn't make it for the full game, but they twisted there answer so that people believe they didn't make it at all.
Edit: I wouldn't mind a level 76-100 as long as it is a continuation of the 5th legacy and level 100 would still be the skull emblem or maybe something different now that the skull is an actual selectable emblem. I bet if some genius hasn't taught about the tournament system we would have gotten stuff like the Djinn as a reward as soon as we reach level 100. It would have fitted with the rank. That's just me speculating though.
