Sounds like a simple network issue?

Well my new ps3 is set with a static IP and is put into the DMZ and a wired connection and some ports are opened for the ps3 as well..

Connection status shows that I am NAT Type2, which is what i have read it should be; but I still lag alot. but I shouldnt be with a 10mps connection.

Its driving me nuts!

Could living in a apartment complex have anything to do with this issue? am I just screwed?

You shouldn't need to manually open ports if your PS3 is properly placed in the DMZ. Upload bandwidth is much more important for online gaming than download bandwidth. Make sure you don't have any bandwidth hogging software like BitTorrent or peer to peer file sharing running on another computer that may be saturating your upload.
