Pretty much, Sony does have rights, just not all of it. And the fact that GungHo Online Entertainment introduced MonkeyPaw (the one who re-released Tomba! on PSN) to Fujiwara-san, the man behind Tomba! & also worked on Tomba 2 & formed Whoopee Camp. Shows that GungHo owns Tomba. They also published both Tomba games on the PSN.

 

Though it shows that Sony has rights & possibly GungHo would too (and for some reason, searching "GungHo Online Entertainment Tomba" on Google shows a user saying Tomba is owned by GungHo in GameFaqs. No source, but they possibly do).

IIRC, the actual usage rights ran out earlier this year.  It was a pretty talked-about topic here on the forums when we found this out, because all the Tomba! fanatics told Sony to buy the rights.  The topic died off, so that link may be more accurate to recent information.  Regardless, Tomba! is so rare that it's a collector's item to most people, and it's so niche that I doubt he'd ever get in.  Not to mention the fact that this thread is just way too filled with BS (not on the OP's part, but on his friend's) to be believable anyway.
