They don't try to argue that the firmware is the issue, just that his lawsuit is stupid.


Analogy for Sony... Just because the engine fell out of your car after you put in bad gas that the car manufacturer said you had use in order to get back on the road with everyone else, doesn't mean you can't push it to the store... oh, and use that gas at your own risk...  or just leave the car in the driveway...


The best part in their argument is their claim that it's still sellable ("merchantable" in the context used here is defined as "An item is deemed merchantable if it is reasonably fit for the ordinary purposes for which such products are manufactured and sold. For example, soap is merchantable if it cleans.") so it hasn't lost all value.  And hey, Sony has a point.  My 60gb PS3 still plays downloaded games and movies.  Sony never stated explicitly that its game system was always going to deliever game & video content via the BD.  Now I know how to frame it, mine's a fully functional PS3.  Anyone out there want to purchase my 60gb fully functional, backward compatible gaming & movie system? It's b/c with the PS1 games you can download direct from Sony.  Anyone?  Bueller?  Huh...guess not. 

 

If I were to put it up for sale as fully functional as per Sony's assessment, would I be accused of fraud?

I'll state what I said in another post... If a disc-based game REQUIRES 3.01 (per their license agreement), and installing such update renders the BR drive unable to read the data off said game's disc, then the game cannot possibly function with 3.01.  It cannot be a *requirement* of the game to render the BR drive inoperable in order to play the disc-based game.

 

I guess Sony believes there is a market to sell PS3's that cannot play BR discs...  The "It only plays everything"  marketing campaign is about to bite them in the rear big time!

EDIT:  I've decided...  I'm not going to be forced to take a chance on breaking my PS3 by loading unsupported firmware on it.  And that truly is what it is: UNSUPPORTED FIRMWARE.  I'm sending back Ratchet & Clank CiT tomorrow.

It just happened to me today.  I'll start a class action suit myself if they don't fix it for free like Microsoft did with the XBOX.
