A disgruntled PlayStation 3 owner in Florida has filed a class action lawsuit against Sony,
claiming that a firmware update made live in early September caused PS3 units to
"malfunction and actually damaged the hardware on many units."
The suit claims Sony is charging $150 to repair PS3s with "sustained hardware damage" from the update.
After some early reports of a problem with update 3.0, Sony issued a fix,
but the Florida man claims Sony's update doesn't actually correct the problem.
In fact, he says the "fix" actually caused further problems with the console's Blu-ray drive.
The suit accuses SCEA of breach of implied warranty, negligence, negligent misrepresentation,
unjust enrichment, and other counts.
The suit is seeking restitution, unspecified monetary damages and legal fees.
As of yet, Sony hasn't commented on the matter.
Although I've read a few scattered posts on the internet about the issue,
my PS3 is fine, and no one I know has had this happen to his or her system either
-- G4 has a lot of PlayStation 3 owners, too.
Still, there are scattered reports on the internet,
and a guy in Florida is angry enough to sue, so maybe there is something to this.

Oh, poo poo for him. He's wasting his money. There aren't enough failures for Sony to be held responisble for anything unlike Mic....
Only a very small percentage of people have broken systems because of this and there still is no concrete proof it was the reason. I mean for real...one of the things is the Blur-ray lens messing up evidently. How can the update effect (affect?) that?

firmware does not damage hardware period . simply put ... when all is said and done this guy will have invested enough money in lawyers fees to buy several dozen legal fees just so he can have a judge tell him that he is a whiny little nutcase .
im pretty shure you have no idea how a fw update works. clearly you dont know much if you stated " firmware does not damge hardware period"
the 3.00 update changed the bios in some chipsets that effect fan speed and drive speed. if some ps3's dont share the same parts as others or have cheap parts that could cause a problem when a bios was changed or new code was added.
3.01 changed every thing back to how it was.
and again how does the fw not effect the hardware?? this should be funny
