Not really, he is a hero, but usually have a anger to them, vengeful. Think of Ichigo, Wolverine, Batman, etc...

In that case, judging from the 3rd pic, hes leaning more towards the villain side right now.

Yeah, I think that pose has a natural malovelent feel to it though.

Too mysterious to tell.  He could be all three, like the guy in the horned-rimmed glasses on Heroes.  Maybe he's a victim too.  I would make it so nobody can tell if he's a good guy or a bad guy.  He should be mysterious and ambiguous.
 
There's another possibility here.  He could be so powerful as to be "beyond good and evil" like Uatu the Watcher.  Now he simply is.  Naturally he would have to be so powerful that if you try to kill him it's instant death.

He looks like a viillian. I like playing as the anti-hero, like Carl in San Andreas.
